Can a lender legally evict me from my home in foreclosure before its auction sale date?

My condo is in foreclosure and an auction sale date is set for January 11th. Today, in shock, some inspector guys came here and were talking about changing the locks. They took pictures…they said they were looking to see if I was still here, that the water was on, and that the heat was on. I have a legal right to stay here until the auction sale, don’t I? I plan to file a bankruptcy too later this month. Please advise.

  5. No, he can’t evict you right now but after auction, you will left with no option other than to leave the house. It is better to leave the house at your own and manage for some other one before he might force you to leave that house.

  6. Yes, in some states the lender is allowed to bypass the sale process and take title to the property without a foreclosure sale if they can prove the property is abandoned. I would also conclude that you have not been filing any response to the foreclosure action or taking care of the property, therefore the lender assumed the property was abandoned.
