Does anyone know of legal rights for a dog owner living in a condo apartment in Westchester, NY?

I’ve had my dog for over 2 1/2 years and a few people are complaining since the Rules & Regulations says no dogs allowed. I’ve been forthright with notifying the management company when I received her and also faxed them information on my pet such as her breed, weight 8lbs, doesn’t bark, etc., including the bill of sale. There are a few (3 people approx) that are stirring the pot saying that I shouldn’t be allowed to keep her. I disagree for mainly 2 reasons: 1) I was honest about my pet 2 1/2 years ago, and 2) she is my family and I can’t live without her. I don’t know what my legal rights are – can someone help me?
To clarify, the Rules & Regulations were posted almost 3 months after I got her.

Generally, the rules and regulations banning dogs would mean you have to either get rid of the dog or move. However, you did everything correct in knocking the association’s feet out from under its ability to enforce those rules.

Of your two reasons to keep the dog. The first is correct (at least in Florida) and the second is irrelevant, legally speaking. The association has known for two and a half years that you had the dog. You may be able to keep it because of "collateral estoppel," "equitable estoppel," and/or "laches." If there are other owners with dogs and there is no effort to make them remove the dogs, then you also have "unequal enforcement" as a defense.

If an enforcement action is taken against you, hire a local attorney who practices condominium/homeowners/community association law. You want an attorney whose practice is at least 50% in those areas of the law and at least 5 years experience practicing law.

How can I protect my credit after my husband goes through a short sale?

Two years ago my husband bought our condo. The condo is only in his name because at the time I was going through a career change and thought my lack of an income would hurt our chances with the loan. That was actually a blessing in disguise. Because of our interest rate adjusting we will not be able to afford the payments. The bank will not approve us for a loan modification because to them having $50 left over at the end of the month is good enough! So we will be doing a short sale. Since the loan is solely in my husbands name, i believe only his credit will be affected. But we have joint bank accounts and credit cards. Do I need to separate our finances so that I will not be hit on my credit score? Because we need my credit score to rent out an apartment. I live in CA, which is a community property state. I’m not worried about taking on his bills because we are together and are doing this together. I just want to make sure that my credit score stays intact so that I can rent an apartment for us. Since I do live in a community property state will that affect my credit score?
Do I even need to worry about my credit score being damaged because my name is not on the loan, but I am his wife, does his bills equal my bills? I’m so confused. Sorry if it was a little long. Any advise is appreciated. Thank you!

Thank you SPIFIMAN1. I don’t think the lender will "go after" us becasue as I understood it, a short sale is an agreement between the lender and us. So we will need to have an approved short sale before we go any further. Thank you very much!

Your credit score will not be affected at all.

On the other hand since California is a community property State you are just as responsible for the repayment of this loan as your husband is.

If you lender comes after you in court separating your your finances will not help. If they do and get a judgment this will show on your credit but by that time you should have already rented a apartment.

How do I get a mortgage modification or short sale if I never had a mortgage?

1. When I moved to California, I was told that I should buy a house or condo, because the mortgage would not cost much more than the rent on an apartment, and the house or condo would go up in value, and I would build equity. However, I was concerned that it might go down in value and that, if I had to move, I would be stuck paying whatever was left on the mortgage. Well, home prices in California did go down, but the lenders allowed short sales and mortgage modifications, so those who bought and have negative equity do not have to pay all of what they owe; some of them were even able to stop paying their mortgages for awhile and keep their homes, even though I had to keep paying my rent.

I do not feel that I should be punished for not making a bad financial decision. How can I qualify for the programs that are helping those who made the mistake that I did not (investing in California real estate)?

2. In another part of the country, where housing is less expensive, my parents bought a house with 100% down, no mortgage at all. It probably lost value, and, if they sell, they will probably receive less than they paid for it. How can they qualify for the programs meant to assist homeowners whose homes went down in value? If they had gotten a mortgage (even though they did not need one), then would not have need to put down as much money as they have already lost, and they would qualify for these programs that would have kept them from losing much more than their downpayment and the payments on the mortgage. Are they really out the entire purchase price (minus whatever the house is worth now). They should not be punished for putting down 100% and not getting a mortgage. So, how do they qualify for the programs meant to assist homeowners whose homes went down in value?

1) Did you even buy a house or a condo? That is unclear by your question.
2) If your parents paid 100% cash for their house and have NO mortgage, then they have no PAYMENTS for what they need assistence for. Just becasue the value went down, that is an UNREALIZED loss. If they SOLD their home for a loss, there is a tax break for that. I do see where you are getting to, but NO ONE is going to give out assistance for something that is ALREADY paid in full. Since it is obvious that they did not need any assistence, why should they get any? These programs are intended to help peopel afford the houses that they overpaid on. Your parents are not in any need of assistance becasue there is ZERO risk of them losing their home.

FYI…..I am 100% against ANY type of modification or program intended to help people keep homes that they had no business buying in the first place. The market created this mess, so let the market FIX this mess. I am actually in a VERY similar position as you are in that I saw the stupidness that was going on during the last 7 years and refused to take any part in it. Yes, it angers me that people are being rewarded for being deadbeats and not paying back loans. Yes, I am angry at the sense of entitlement that these people have in that they feel that the government MUST help them keep their $500,000 house while only making $50,000 per year. The bank MUST modify their loan becasue the value of the home fell. I am with you brother!! Unfortunatley, we live in a country where those who play by the rules get shafted and those who don’t get handouts…paid for by me and you.

Materialistic, stupid, lazy, selfish wife! What to do?

I’ve been married to my wife for 10 yrs. We have 2 teenage daughters and another baby on the way. I met her in college, I was attracted to her personality, she was a great woman. We both have excellent jobs, She’s a financial manager for a bank and I am a software engineer. 1st, we can’t agree on ANYTHING. Last year I didn’t want a new car, she wanted one. We argued so bad, she went out and purchased a $175,000 dollar Bentley Continental Flying Spur!! Even when I asked her not too!! Now she is in serious debt, she spends all her money on expensive clothes, shoes, etc and now I am in debt as well. We purchased a $400,000 dollar home in 2002…a home I NEVER wanted. We are going broke, she doesn’t understand it but we are. I want to put the home up for sale and move into an apartment or condo. She cried and broke down, she said she would absolutely NOT move out of the home even though we can’t afford it. I have been thinking about a divorce? What do you think? I can’t take this.
Let me finish up here, she has went into OUR joint bank account and took out $40,000 for a boob job/nose job/ other things that she DIDNT need. She never told me she was going to take it out!! She buys excessively even though I have put her on a budget and I am on a budget as well. She let’s our daughters run free with OUR credit cards even though I asked her to limit their spending as well. I am thinking ahead about the future, we can’t continue to live like this. Our whole future will be destroyed, she says all the time "it’s okay, we will make the $$ back" but it’s not about that, its about being smart and acting like you have common sense. She won’t have the bentley for very long because she has two other cars she’s paying for, they will get taken away. We have a baby on the way!! I’ve talked to her but it’s not going through her head. I think she is swindling money from her job as well!

Drastic measure demands drastic actions.

Before this gets out of hand, you may want to get as much as you can into your name to clear up your debts. If she gets a credit card, she will be only damaging her own credit at that point.

I would encourage you to either seek counseling and/or an attorney to see what your options are.

I’m so glad I’m not a materialistic and lazy person! My job is to help contribute to the household and do my fair share around the house. The bills and necessities come first. Then build up savings and when you have a little additional dollars, treat yourself. But this sounds very much excessive.

I need boyfriend advice?

My boyfriend and I are in the proces of finding a place to move in together.. His busy work schedule only allows me 2nights per week to spend the night with him and its been bothering me. I feel that I need more than just 2 full nights per week.Thats why we are trying to find an apartment together.. Besides all that.. My landlord has my condo for sale so i have 1 month to move..But… My background is not clean. I did something stupid years ago and I have been getting denied by the apartment management companies.And i know it is getting frustrating for him since we prefer to have both our names on the lease.
Can anyone please suggest something?

hi i am an expert on this i live here with my wife and baby we have recently moved here to mandaluyong close to makati. there are several condos for rent in the price range 200 a month to 2000 dollars a month. the 200 dollar a month units are very small. stay in a hotel for a few days get you a buy and sell paper when you get here and go to real estate. if you like it here you can buy condos pretty reasonable. if you are a citizen here or you are married or you have a filipino business partner to buy them for you. we americans cannot own property here unless we are a dual citizen. i am jerry my email is jcr41629@yahoo.com if you would like to ask any more questions
