Can my landlord make me move out before my lease is up to sell their property?
My landlord has been renting me their condo for 7 months.I signed a 12 month lease and have made all my payments on time, kept the apartment clean, and followed me lease. About 2 weeks ago a man came to the door to inform me that the condo had been foreclosed, I immediately contacted my landlord and she told me that she was currently looking into having the bank lower her payments and i shouldn’t have to worry about it. A week later, she e-mailed me telling me that i had to be out by may 31 because she is putting the condo for sale to avoid foreclosure… my lease isn’t up until august.I am a student and have nowhere else to go or store my things in this city since my family lives 5 hours away and cannot afford such a sudden move.
NO! That is illegal. Nobody can ever force you to leave if you have a lease and have not violated it in anyway. That is the entire point of having a lease. A foreclosure nor a sale voids your lease. The lease goes with the property. When she sells any new owner is required to honor your lease. If it does foreclose the federal law now requires the bank to honor your lease as well.
Well, what do you expect her to do?!?! You can move out so she can sell it, or you can move out when it gets foreclosed. Either way you will be out. What do you mean – you have no place else to go? There are no other apartments to rent in your city? See if your landlord would be willing to pay for your move since they are breaking the lease.

You shouldn’t have to move until the end of the lease. When rental property is sold, the lease goes with it. Call the county court house and ask for the number to the department that handles landlord/tenant issues. Someone there will be able to tell you what your rights are.
